Overview 

This course satisfies the 3 Hour Hawaii State Law component of the pre-licensing education requirement for the State of Hawaii. We cover Hawaii’s SAFE Act, Interest and Usury, the Fair Credit Extension Act, Unfair and Deceptive Practices Law , Land Court Dual System, Lava Zones, Hurricane Insurance and Fiduciary Duties.

Format 

Online Instructor Led (“OIL”). This education is delivered in the Online Instructor Led format as required by the NMLS for online Pre-Licensure (“PE”) education. It is available on our website through any internet connection.

Description

This course satisfies the 3 Hour Hawaii State Law component of the pre-licensing education requirement for the State of Hawaii. We cover Hawaii’s SAFE Act, Interest and Usury, the Fair Credit Extension Act, Unfair and Deceptive Practices Law , Land Court Dual System, Lava Zones, Hurricane Insurance and Fiduciary Duties.

The course is divided into six sections:

Section 1: State Regulatory Agency and State Law Summaries: covers the regulatory authority, structure, and responsibilities and limitations of the Hawaii State Department of Financial Institutions (DFI). Also summarizes the intent and purpose of each law.

Section 2: Hawaii License Law and Regulations: covers persons required to be licensed, licensee qualifications and the application process, the grounds for denying a license and license maintenance.

Section 3: Compliance: details prohibited conduct and practices, required conduct, fees and charges, disc qq hlosures and agreements, and advertising. This section also covers disciplinary action.

Section 4: Usury: reviews the Usury Act regarding consumer protection from unfair interest rates and various statutes from Chapter 478. Also covers judgment and rejection of federal laws.

Section 5: Unfair and Deceptive Practices: this section covered the unfair competition and deceptive practices section 480-2, as well as the Fair Credit Extension 477E.

Section 6: Other Hawaii Laws: this section covers the Land Court Dual System, Lava Zones, Hurricane Insurance, Condominium Requirements and Fiduciary Duties.
